DEBTOR CASES

Most people truly want to avoid filing bankruptcy. However, there are situations where filing for bankruptcy is the only alternative and others where sound legal advice might avoid the necessity of bankruptcy. Many people do not know about the different types of bankruptcy and what they offer. For instance, you may be able to keep your house, even though it is in foreclosure, or to keep you car, even if you're behind on the car payments. If you are having financial problems you should consult with an experienced lawyer about your legal rights and options.

CREDITOR REPRESENTATION

When a bankruptcy is filed, a creditor cannot (with few exceptions) proceed to do anything to collect a debt or recover property from the debtor. When a bankruptcy case is filed, legal action shifts to the jurisdiction of the U.S. Bankruptcy Court. To protect one's rights to payment or to recover property in the possession of the debtor, it is advisable to consult with an attorney experienced in such matters.
